TIME LIMITS
Strict time limits apply to motor vehicle accident claims, whether you are a driver of a motor vehicle, the passenger, cyclist or a pedestrian. Therefore it is imperative to obtain legal advice as soon as possible from a qualified compensation specialist who will ensure that you receive the maximum compensation you are entitled to.
You have 24 hours to report your motor vehicle accident to the police. Failing to do so will potentially result in you having to go to court and proving that sufficient cause existed to justify the delay. The police will then give you an “event” number as a record of the notification of the accident.
The Accident Notification Form must be lodged within 6 months from the date of the accident.
The Accident Notification Form can be refused if it is lodged later than 6 months of the accident occurring. It is possible to make a claim more than 6 months after the accident, however you are required to provide a full and satisfactory explanation for the delay in writing to the insurer.
A claim cannot be accepted if it is lodged later than 3 years after the date of the accident.
Compensation for minor injuries arising from motor vehicle accidents
